Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  • Cooling-off period: the period within which the consumer can exercise their right of withdrawal;

  • Consumer: the natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur;

  • Day: calendar day;

  • Continuing performance contract: a distance contract regarding a series of products and/or services, the delivery or consumption of which is spread over time;

  • Durable medium: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction;

  • Right of withdrawal: the ability for the consumer to withdraw from the distance contract within the cooling-off period;

  • Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance;

  • Distance contract: a contract concluded within a system organized by the entrepreneur for selling products and/or services at a distance, in which only one or more means of distance communication are used until the contract is concluded;

  • Means of distance communication: any means that can be used for concluding a contract without the consumer and entrepreneur being simultaneously present in the same location;

  • Terms and Conditions: these Terms and Conditions of the entrepreneur.

Article 3 – Applicability

  1. These Terms and Conditions apply to every offer of the entrepreneur and to every distance contract and order between the entrepreneur and the consumer.

  2. Before a distance contract is concluded, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated where the Terms and Conditions can be inspected and provided free of charge upon request.

  3. If the distance contract is concluded electronically, the Terms and Conditions may be provided electronically in a way that allows the consumer to store them on a durable medium. If this is not reasonably possible, it will be indicated where the Terms and Conditions can be accessed electronically and that they will be sent free of charge on request.

  4. If specific product or service conditions apply in addition to these Terms, the provisions of paragraphs 2 and 3 apply accordingly, and in case of conflict, the consumer may rely on the provision most favorable to them.

  5. If one or more provisions of these Terms are invalid or canceled, the remaining provisions remain in effect. The invalid provision will be replaced in consultation to approximate the original intent.

  6. Situations not addressed in these Terms are to be assessed according to the spirit of these Terms.

  7. Ambiguities in the interpretation of any provisions shall also be interpreted according to the spirit of these Terms.


Article 4 – The Offer

  1. If an offer has a limited validity period or is conditional, this will be explicitly stated.

  2. The offering is non-binding; the entrepreneur may change or adjust it.

  3. The offer contains a complete and accurate description of the products and/or services. Images, if used, provide a truthful representation. Obvious mistakes in the offer do not bind the entrepreneur.

  4. Images, specifications, and data are indicative and cannot be used for compensation claims or contract dissolution. Colors shown may not exactly match the real product.

  5. Each offer clearly informs the consumer of their rights and obligations, including:

    • Price (excluding import duties and VAT if applicable);

    • Shipping costs;

    • How the contract is concluded;

    • Applicability of the right of withdrawal;

    • Payment, delivery, and execution procedures;

    • Validity period of the offer;

    • Communication costs if different from standard rates;

    • Archiving of the contract;

    • Data verification procedures;

    • Available languages;

    • Codes of conduct;

    • Minimum duration for continuing performance contracts.

  6. Optional: available sizes, colors, materials.


Article 5 – The Agreement

  1. The contract is concluded upon acceptance of the offer by the consumer and fulfillment of any conditions.

  2. For electronic acceptance, the entrepreneur will immediately confirm receipt electronically. Until confirmed, the consumer may dissolve the contract.

  3. The entrepreneur implements appropriate technical and organizational measures to ensure secure data transmission and payment.

  4. The entrepreneur may verify the consumer's ability to meet payment obligations and may refuse or set conditions for orders if necessary.

  5. Information on complaints, withdrawal rights, guarantees, service, and contract details will be provided in an accessible form on a durable medium.


Article 6 – Right of Withdrawal

  1. Consumers have 30 days to withdraw from the purchase without giving reasons, starting the day after receipt of the product.

  2. During this period, the consumer must handle the product and packaging with care, using it only as necessary to assess whether they wish to keep it.

  3. To exercise the right of withdrawal, the consumer must notify the entrepreneur in writing/email within 30 days and return the product within 30 days, providing proof of shipment.


Article 7 – Costs in Case of Withdrawal

  1. Return shipping costs are fully borne by the consumer, including shipments to the country of origin (our supplier in China).

  2. Refunds will be processed within 30 days after receipt of the returned product or proof of shipment.


Article 8 – Exclusion of the Right of Withdrawal

  1. The entrepreneur may exclude certain products or services from the right of withdrawal if clearly stated in the offer.

  2. Exclusions include:

    • Custom-made or personalized products;

    • Products not suitable for return due to nature;

    • Perishable goods;

    • Items with prices linked to financial market fluctuations;

    • Loose newspapers, magazines, audio/video media, software, or hygiene products if seal is broken;

    • Services for accommodation, transport, events, gambling, and lotteries under certain conditions.


Article 9 – Prices

  1. Prices are fixed during the offer's validity, except for changes due to VAT or financial market fluctuations.

  2. Price increases within 3 months are only allowed due to legal regulations; after 3 months, only if agreed and with the right to terminate.

  3. Delivery occurs outside the EU; import VAT and customs costs are borne by the consumer.

  4. All prices are subject to typographical errors. The entrepreneur is not obliged to honor incorrect prices.


Article 10 – Conformity and Warranty

  1. Products and services comply with the contract, specifications, reasonable standards of quality and usability, and applicable legal requirements.

  2. Manufacturer warranties do not affect statutory consumer rights.

  3. Defects must be reported within 30 days; Returns should be in original packaging and in new condition.

  4. Warranty does not cover improper use, repairs, or modifications by the consumer or third parties.


Article 11 – Delivery and Execution

  1. The entrepreneur will exercise the utmost care in handling orders.

  2. Delivery takes place at the address provided by the consumer.

  3. Orders will be executed promptly, at the latest within 30 days , unless a longer period is agreed.

  4. In case of cancellation or impossibility to deliver, the entrepreneur will refund payments or offer replacement products.

  5. Risk of damage or loss passes to the consumer upon delivery unless otherwise agreed.


Article 12 – Continuing Performance Contracts

  1. Termination: Consumers may terminate contracts with indefinite duration or recurring deliveries at any time with a maximum notice of one month.

  2. Extension: Contracts for a set period may not be automatically renewed unless explicitly allowed (eg, subscriptions for magazines up to 3 months).

  3. Duration: Contracts longer than one year may be terminated by the consumer after one year with one month notice, unless fairness dictates otherwise.


Article 13 – Payment

  1. Payments are due within 7 days after the cooling-off period begins, unless otherwise agreed.

  2. Consumers must report errors in payment details immediately.

  3. In case of non-payment, reasonable costs may be charged.


Article 14 – Complaints

  1. Complaints must be submitted within 7 days of identifying defects.

  2. The entrepreneur will respond within 30 days , providing updates if longer processing is required.

  3. If unresolved, disputes may be addressed through the dispute resolution process.

  4. Complaints do not suspend the entrepreneur's obligations unless stated otherwise.

  5. If justified, products will be replaced or repaired free of charge.


Article 15 – Governing Law and Jurisdiction

  1. Dutch law exclusively applies to agreements between the entrepreneur and consumer, even if the consumer resides abroad.
